Abstract

The security challenges and disastrous conflicts that occurred during the twentieth century have considerably
influenced the evolution of state agents present on the international stage. The need for independence and sovereignty
dominated the 1990s and were some of the key elements for the well-being of citizens and the inner balance of the
state. Thus, in order to satisfy their own interests, states with a strong influence globally, under the auspicies of
international or regional organizations, to help entities eager to be independent, using humanitarian considerations.
This paper focuses on the authentic reasons behind the illegitimate intervention of the N.A.T.O., respectively the
U.S., in the 1999 Kosovo Serb conflict and the analysis of UN General Assembly Resolution 3314 to observe
whether or not an aggression crime has been committed. The research methods used in this paper are well known
in the field of scientific research: the analytical, descriptive method, but also that of the case study, where we will
analyze all identified factors by which we can demonstrate the hypothesis that, under the auspices of the North
Atlantic Organization, The United States was able to pursue its interests in the Balkans during the 1999 intervention
in Yugoslavia, specifically in the Kosovo region. Following the case study, we concluded that during the 1999 Kosovo
War, the crime of aggression was committed by the U.S.A. through an international organization whose mission was
to intervene „humanitarianly” in order to protect citizens from the regime’s atrocities.
